bonds are a special type of bail bond requested by a federal court federal government agency for issues related solely to questions of legal U.S. residency and citizenship. Jurisdiction for immigration bond matters lies solely with the federal government and its two primary agencies that deal directly with immigration issues: the U.S. Immigration and Customs Enforcement Agency (ICE) and the Department of Homeland Security. State and local governments have no jurisdiction over immigration bond issues.

Tracing the Immigration Bond Process

When an individual is detained by a federal agent on matters related to immigration status, they are placed in a federal immigration detention center. A federal agent or judge (usually a representative from ICE or the Department of Homeland Security) will set the immigration bond amount (which tends to be higher than typical bail bond amounts) to help guarantee the defendant shows up for all scheduled immigration hearings and ICE appointments, and ultimately, will leave the country if the federal court or agency issues a final order for deportation.
